Pfizer to pay Nevada $9.5 million to settle postmenopausal drug claims

Pfizer will pay Nevada $9.5 million to resolve the state’s claims that Pfizer and Wyeth Pharmaceuticals unlawfully promoted certain postmenopausal hormone therapy medications and misled Nevada consumers and doctors about the safety and effectiveness of those drugs, Attorney General Catherine Cortez Masto said Monday.

Pfizer, which acquired Wyeth in 2009, agreed last week to make an $8 million donation that will go toward the University of Nevada School of Medicine and the University Medical Center to fund Nevada health care programs affecting women’s health issues.

A consent judgment from August requires Pfizer to ensure its marketing and promotional practices do not unlawfully promote any of its products. The agreement prevents Pfizer from making any written or oral claim that is false, misleading or deceptive, making any claim comparing the safety or effectiveness of a Pfizer Product to another product when that claim is not supported by substantial evidence, and promoting any Pfizer product for off-label uses.

Pfizer also will pay of $1.5 million to the attorney general’s office for the costs of the investigation.
