$79,500 fine, suspension against UFC’s Diaz affirmed

Clark County District Judge Joanna Kishner on Friday threw out UFC star Nick Diaz's case against the Nevada Athletic Commission, meaning the fine and suspension issued by the commission will stand.

Diaz was fined a $79,500 and suspended for one year after a May hearing where the welterweight contested a positive marijuana test after his loss to Carlos Condit in February.

Attorney Ross Goodman had argued that Diaz was legally allowed to use medicinal marijuana and that the NAC test showed only the presence of inactive marijuana metabolites.

Diaz will be able to re-apply for a license in Nevada as soon as his suspension expires on Feb. 4. He is expected to fight champion Georges St. Pierre for the welterweight title in March, though the bout has yet to be officially announced by the UFC.

The UFC reached another settlement with one of the two class-action litigants, agreeing Thursday to pay the former fighters $375 million after a previous agreement was thrown out by a Nevada district judge.
